Terms & Conditions
1. Definitions:
For this document, "Client" refers to any business or individual who engages in Real Media Partners' services. Real Media Partners may be referred to as "RMP."
2. Image Usage and Copyright:
All images delivered by RMP are considered a single-use license. RMP reserves the copyright of all images, media and deliverables. Images or media may not be reproduced or sold to another party without RMP's written permission and consent. Images delivered should not be altered in any way without prior written consent from RMP.
3. Payment and Cancellation:
Payment is expected at the time of delivery. RMP accepts all major credit cards, including Visa, Master Card, American Express, and Discover. RMP will not accept personal or business checks, wire transfers, ACH transfers, digital currency, barters, or advertising as payment. Late fees will be assessed at 20% per week for overdue payments. Payments more than 60 days late will be sent to a collection agency. Cancellations within 72 hours will be billed at 50%, and cancellations within 24 hours will be billed at 100%, both subject to the late fee policy.
4. Appointment Timing:
While RMP endeavors to be punctual, appointments may have a 90-minute window on either side of the requested time. Appointments within this window will be considered 'on time' and not subject to service discounts.
5. Safety and Responsibility:
The client is responsible for the safety of RMP photographers and its affiliates while on site. If an RMP photographer feels threatened in any way while on site, they have the right to leave immediately, regardless of progress. Examples could include but are not limited to, property/buildings that are not structurally sound, strong chemical smells or evidence of harmful chemicals, insect infestations, unsecured firearms, evidence of drug or alcohol abuse, and unrestrained animals. The client is responsible for any injury or damage due to property negligence or criminal activity. Such properties will be subject to the prevailing cancellation rate.
6. Additional Charges:
Subject properties without power, properties with pools, additional buildings, storage facilities, or large outdoor areas exceeding 500 sq ft will incur additional fees. Additionally, images captured beyond the scope of the requested package will be subject to our current shop rate. As of October 1st, 2023, this rate is $7 per image.
While we make every effort to honor the quoted price at the time of booking, we reserve the right to adjust the package to meet specific project requirements. If the project cost exceeds the quoted price by 20% or more, RMP will seek client approval onsite before proceeding with the additional work.
7. Accuracy and Measurements:
The client is responsible for verifying all measurements and details in the delivered media. While RMP strives for accuracy, floor plans and measurements are reliable but not guaranteed. Clients are strongly advised to cross-check and verify all measurements and floor plans before use. Additionally, property lines shown in media are approximations and should never be used as a substitute for professional surveys. Clients should conduct their own surveys and seek professional advice for property boundaries and legal matters related to the property. RMP will not be held liable for any discrepancies related to measurements or property lines after media delivery.
8. Preparation and Waiting Time:
The client is responsible for ensuring that the property is adequately prepared before the scheduled arrival of RMP. Time spent waiting due to unpreparedness will be billed at a rate of $75 per hour. This includes but is not limited to, tasks such as moving cars, decluttering, repositioning furniture, and relocating pets.
Furthermore, any additional time spent accommodating the presence of people, pets, guests, or contractors during the photography session will also be billed at $75 per hour.
9. Travel:
Travel is included up to 20 minutes each way or 15 miles. Travel beyond this distance will be billed at $0.65/mile and a $30 fee. Each additional hour of travel is billed at $30/hour.
10. First Time Customers:
To maintain the highest standards of professionalism and security, RMP requires a designated business representative to meet us on location for all first-time customers.
11. Booking Procedure:
All appointments are encouraged to be booked through our secure online platform. Appointments made over the phone or in person will be subject to a convenience fee of $25. In the rare event of technical issues preventing the use of our online platform, the $25 fee for phone or in-person bookings will be automatically waived.
12. Health and Acts of God:
Missed appointments, cancellations, or no-shows due to sickness, illness, "acts of God," or death will be waived any fees or charges. RMP will reschedule appointments missed due to these issues in the next available time slot unless a cancellation is requested in writing.
13. Weather:
We ask that you allow us to use professional judgement to decide if the weather will be too severe to proceed with a scheduled appointment. In the event that RMP believes it is necessary to reschedule, that will be done at no additional cost to the customer.
14. Pets:
As a mandatory requirement, all pets must be securely enclosed, caged, or kept off the property during the photography session.
15. Properties Under Construction and Working Conditions:
During the photography session, properties under construction must be completely vacant, with all power equipment and machinery ceased while RMP is onsite.
16. Project Coverage:
While RMP strives to capture the project in alignment with the client's vision, we must note that we may not cover every corner or angle during a session. Requests for additional trips to capture media not included in the original session will be considered separate assignments and billed at the total price of the respective services. Clients must provide detailed instructions and specific requirements before the initial session.
17. Storage and Media Requests:
RMP attempts to store all delivered media for 365 days from the date of delivery. However, it is the client's responsibility to download, back up, and securely store the media provided.
Any requests related to a project after it has been delivered and accepted by the client are subject to our current shop rate. As of October 1st, 2023, this rate is $275/hour. Clients are advised to promptly download and safeguard their media to avoid additional charges related to future requests or retrieval of the files.
18. Revisions and Disputes:
Upon delivery, our commitment includes one complimentary revision to ensure your complete satisfaction with the final product. Any additional revisions beyond this initial review will be subject to negotiated fees, which will be determined based on the scope and complexity of the requested changes. In the event of any disputes regarding the delivered media or our services, we employ a professional and impartial mediator to facilitate a fair resolution. We earnestly desire to address any concerns promptly and equitably, ensuring your confidence in our services. However, should a resolution not be achieved through mediation, and the matter is escalated to a court of law, the client will be responsible for covering all associated legal costs. We believe in transparent communication and fair practices, and these policies are in place to uphold the highest standards of professionalism and accountability in our business transactions.
19. Client Responsibility for Accessing Deliverables:
While RMP will exert significant effort to aid clients in accessing their deliverables, clients must take responsibility for their technical competence. Clients should possess the necessary know-how to access, store, safeguard, upload, download, and resize the media files provided to them.
Although we are committed to assisting our clients, any requests related to troubleshooting computers or accessing deliverables that exceed a cumulative duration of 10 minutes will be invoiced at our prevailing shop rate. As of October 1st, 2023, this rate is $275 per hour. We encourage clients to proactively address technical concerns to ensure a seamless experience and efficient utilization of our services.
20. Information Usage:
By providing your information to RMP, you consent to the use of this information for essential business purposes, including media delivery, correspondence, marketing, and advertising. RMP will not sell client information to third parties. Upon submitting your information to RMP, you acknowledge and agree to receive email, text, mail, and phone call correspondence from RMP and its affiliates. This correspondence will pertain to the services you have ordered and marketing communications regarding future services, offerings, and updates related to pricing, policies, and terms and conditions.
21. Pricing:
Pricing for services provided by RMP is subject to change at any time. Updates to pricing will be posted on our official website. The appointment pricing will be honored at the rate applicable when booking, regardless of any subsequent price changes.
22. Client Responsibility for Record-Keeping:
It is the sole responsibility of the client to store and maintain records of past receipts and sales related to 7499 Realty Photography's services. Clients must account for financial transactions, including invoices, payments, and receipts, for their records and tax purposes. RMP will provide invoices and receipts for services rendered; however, clients are encouraged to organize and retain these documents for their financial records and reporting requirements. Proper record-keeping is essential for financial transparency and accountability, and clients are advised to maintain a meticulous record of all transactions involving our services.
23. Misrepresentation of Project Type:
If work is falsely booked as intended for use in a real estate sales transaction but is later found to be for a different purpose, it will be billed at our current shop rate. As of October 1st, 2023, this rate is $275/hour. The client is responsible for accurately representing the nature of the project at the time of booking to avoid any billing discrepancies.
24. Supervision of Children:
Children must always be supervised while an RMP photographer is onsite for safety and liability reasons.
25. Damages to Equipment:
Clients are liable for any damages to RMP's equipment caused by the client, property owner, property owner's children, or pets while on site. In the event of damage or breakage, clients will be invoiced for the replacement costs of the equipment, which may also include the loss of income at our prevailing rates until the damaged equipment is replaced or repaired.
26. Booking Authority and Invoicing:
Appointments should only be booked by a designated business representative with the authority and ability to pay for the services rendered. Invoices will be emailed to the contact person entered when booking the appointment. The contact person provided must have the financial responsibility and authorization to handle payment matters on behalf of the client. Please note that significant changes to bookings, such as rescheduling or modifications to the scope of services, may incur a service fee of $25.
27. Payment Handling and Change Fees:
Clients are responsible for any costs associated with returned payments, refund requests, or changes in payment methods. A $25 change fee will be applied for each occurrence. Clients who have stored cards on file agree to permit RMP to charge the payment on file for services rendered.
28. Promotional or Free Product Offerings:
Services advertised as "free" on the Internet are subject to availability and limited to orders exceeding $225. Free Floorplans provided as part of promotions are basic drawings that include room measurements but do not encompass furniture or Heated/GLA Sq Ft measurements. Clients availing of promotional or free offerings should anticipate delivery within up to 3 business days. It's important to note that these promotional offerings do not include any revisions.
29. Mediation and Legal Costs:
In the event of any disputes, our first approach is to seek resolution through mediation, a process aimed at amicably resolving differences with the assistance of a neutral third party. Should the disagreement escalate to a court of law and RMP is not found responsible, the client will cover all associated legal costs, including court fees, travel expenses, and related expenditures.
30. Agreement and Changes:
By placing an order for our services, the client acknowledges and agrees to abide by the terms and conditions outlined herein. These terms constitute a binding agreement between the client and Real Media Partners.
Any revisions or alterations to these terms and conditions will be communicated to the client at the time of their next booking or before it. We are committed to ensuring our clients are well-informed about any updates or changes, thus maintaining transparency and fairness in our business practices. Your continued use of our services after being informed of any modifications implies your acceptance of the updated terms and conditions.
